Calico Jack Charters Terms & Conditions

1. INTRODUCTION

These Terms & Conditions govern all bookings and participation in expeditions operated under the Calico Jack Charters brand.

Calico Jack Charters is the commercial brand for:

  • PT Calico Jack Perkasa (KLM Calico Jack)
  • PT Anne Bonny Jelahjaya Perkasa (KLM Anne Bonny)

The contracting entity will be specified on your invoice.

By confirming a booking, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

2. DEFINITIONS

Guest: Any individual participating in an expedition.

Expedition: A liveaboard voyage operated by Calico Jack Charters.

Booking: The confirmed agreement between the Guest and Calico Jack Charters.

Vessel: KLM Calico Jack or KLM Anne Bonny.

3. EXPEDITION NATURE OF TRAVEL

All voyages are expedition-based and operate in remote regions of Indonesia.

Guests acknowledge that:

  • itineraries are flexible by design
  • routes, schedules, and dive plans may change based on:
    • weather and sea conditions
    • safety considerations
    • wildlife opportunities
    • operational factors

No specific dive sites, routes, or conditions are guaranteed.

These adjustments are an essential part of expedition travel and do not constitute grounds for refund.

4. BOOKINGS & PAYMENTS

4.1 Booking Confirmation

A booking is confirmed upon receipt of:

  • a 30% non-refundable deposit
  • within 7 days of invoice issue

If payment is not received within this period, the reservation may be released.

4.2 Balance Payment

The remaining balance is due 60 days prior to departure.

Failure to pay may result in cancellation of the booking without refund of deposit.

4.3 Short Notice Bookings

Bookings made within 60 days of departure require full payment at confirmation.

4.4 Payment Methods

Payments may be made via:

  • bank transfer (preferred)
  • credit card (surcharge applies)

Payment details are provided on invoice.

5. INCLUSIONS & EXCLUSIONS

5.1 Included

  • Accommodation onboard (double or twin cabin)
  • Full board meals, snacks, tea, coffee, and soft drinks
  • Guided diving (typically up to 3 dives/day, subject to conditions)
  • Tanks (12L) and weight belts
  • Airport transfers on designated embarkation days
  • Kayaks and paddleboards
  • Starlink Wi-Fi (availability not guaranteed in all regions)
  • Standard first aid and emergency oxygen

5.2 Not Included

  • International and domestic flights
  • Hotels and transit accommodation
  • Marine park and harbour fees (subject to change)
  • Dive equipment rental
  • Nitrox
  • Alcoholic beverages
  • Dive courses
  • Satellite phone usage
  • Crew gratuities (recommended: 10%)
  • Dive and travel insurance (mandatory)

6. GUEST RESPONSIBILITIES

By confirming a booking, you agree that:

  • all Guests meet the required certification and experience levels
  • all Guests are medically and physically fit for diving and remote travel
  • all Guests comply with instructions from the captain and crew

Guests are responsible for:

  • arriving at the designated embarkation point on time
  • ensuring all required documentation is valid (passport, visas, etc.)
  • complying with all applicable laws and local regulations

Failure to meet these requirements may result in denial of boarding or participation without refund.

7. DIVING REQUIREMENTS

Minimum requirements:

  • Open Water certification (or equivalent)
  • Minimum 10 logged dives

Calico Jack Charters reserves the right to:

  • require a check dive
  • restrict or suspend diving activities

if deemed necessary for safety.

8. INSURANCE (MANDATORY)

All Guests must hold valid insurance covering:

  • dive accidents
  • emergency evacuation

We strongly recommend additional coverage for:

  • trip cancellation
  • travel disruption
  • personal equipment

Failure to obtain adequate insurance is at the Guest’s own risk.

9. CHANGES & TRANSFERS

  • Changes to booking dates within 60 days are treated as cancellations
  • Guest substitutions are permitted up to 14 days prior to departure
  • Replacement Guests must meet all participation requirements

10. CANCELLATION POLICY

10.1 Guest Cancellation

  • More than 60 days before departure:
    → 30% deposit retained
  • 60 days or less before departure:
    → 100% of expedition cost charged

10.2 Cancellation Credits

At the sole discretion of Calico Jack Charters, cancellation credits may be offered for future expeditions.

This is not guaranteed and will be assessed case-by-case.

11. NO-SHOW POLICY

Failure to arrive at the agreed embarkation point is treated as a cancellation.

No refund will be provided.

Guests are responsible for any costs associated with catching up to the vessel if feasible.

12. EXPEDITION CHANGES

Calico Jack Charters reserves the right to:

  • modify itineraries
  • adjust dive plans
  • change routes or schedules

at any time for reasons including:

  • safety
  • weather
  • operational requirements

Such changes do not entitle Guests to refunds.

13. FORCE MAJEURE

Force majeure includes, but is not limited to:

  • natural disasters
  • pandemics
  • government restrictions
  • war or civil unrest

In such cases:

  • expeditions may be modified, delayed, or cancelled

Refunds are not guaranteed.

Where possible, Calico Jack Charters may offer:

  • rescheduling options
  • credit toward future expeditions

14. COMPANY CANCELLATION

If Calico Jack Charters cancels an expedition for reasons other than force majeure:

  • Guests will be offered:
    • a suitable alternative expedition or
    • a full refund of payments made

15. LIABILITY

Guests acknowledge that expedition diving involves inherent risks.

Calico Jack Charters shall not be liable for:

  • personal injury, illness, or death arising from participation
  • loss or damage to personal property
  • delays, disruptions, or missed connections
  • actions or omissions of third-party providers

To the fullest extent permitted by law, liability is limited to the amount paid for the expedition.

16. PERSONAL BELONGINGS

Guests are responsible for their personal belongings and dive equipment.

We recommend appropriate insurance coverage.

17. SINGLE OCCUPANCY

Single occupancy may incur a surcharge of up to 80% of the cabin rate.

18. DATA & PRIVACY

Personal data is processed in accordance with applicable data protection laws.

19. GOVERNING LAW

These Terms & Conditions are governed by the laws of Indonesia.

Any disputes shall be resolved under Indonesian jurisdiction.

20. ACCEPTANCE

By confirming a booking, you agree to these Terms & Conditions in full.
